Govt to bring Ordinance for protection of temples in Valley


The Government has decided to bring an Ordinance for Constitution of Board for management and protection of Hindu Shrines and Temples in Kashmir Valley.

This assurance was given by Chief Minister, Omar Abdullah during the meeting of Apex Committee on Migrants here today.

The meeting among others was attended by Revenue, Relief and Rehabilitation Minister Raman Bhalla, MoS Revenue, Relief and Rehabilitation Nasir Aslam Wani, Chief Secretary, Madhav Lal, Principal Secretary Finance, Iqbal Khandey, Commissioner Secretary Revenue, B A Runyal, Divisional Commissioner, Dr Pawan Kotwal and Relief and Rehabilitation Commissioner, R K Pandita.

Official sources told Jk News that the Chief Minister announced in the Apex Committee meeting that an ordinance regarding the formation of Board for protection and management of Hindu shrines in the Valley will be brought in the next Cabinet meeting.

Omar also agreed to give two years age relaxation to those youth who had applied for job under PM's package in 2008 as the package was implemented in 2010. It was decided that the children born after migration will be taken for Kashmir darshan.

He also agreed in principle the demand regarding enhancement of cash relief and compensation for construction of houses in Valley. He informed the meeting that the issue has already been taken up with Prime Minister, Dr Manmohan Singh and Home Minister, P Chidambaram.

It was also decided that all other Apex level Committee that the members, who abstains from two consecutive meetings will be dismissed from the Apex Committee.

The CM told the Apex Committee that he would himself chair two meetings of the Committee in a year, one each in Jammu and Srinagar, to review the progress and implementation of the decisions taken by the Committee headed by Raman Bhalla.

The meeting lasted four hours and all the issues concerning the displaced people were discussed. The meeting was told that there will be no coercion in return of the migrants and no decision will be taken in haste in view of the past experience, which resulted in Vandhhama and Nadimarg incidents. Out of total 38 Apex Committee members 24 were present while 14 abstained.

The other issues raised by the Apex Committee members included construction of shopping complex at Jagti township for those traders of the community who had their small business establishments in erstwhile camps.

Bhalla described the meeting very fruitful and healthy. He also criticized those Apex Committee members, who boycotted the meeting.

The prominent among the Apex Committee members who attended the meeting included Vijay Bakaya, MLC, Khem Lata Wakhloo, H N Jatu, M L Kaul, Hira Lal Pandita, Sanjay Saraf, R K Bhat, Roshan Lal Raina, Bansi Lal Kaul, M K Yogi, Anil Dhar, Jatin Bhat, Din Mohammed Cheeta, Ashok Hangloo and A K Rajpuri.

Meanwhile, Kashmiri Pandit Sabha representatives including its president Prof A N Sadhu and vice president K K Khosa who are the members of Apex Committee also boycotted its meeting today in protest against the failure of Government to solve the burning issues of displaced Pandits.

A statement issued here by K P Sabha said the community leadership has been pressing hard for the enhancement of cash relief, passage of Shrines and Temples Bill, sincere and timely implementation of PM's package and adequate facilities at the Jagti township. But there has been no encouraging response from the Government, it added.

The statement said in the wake of high market inflation, the meager cash relief is grossly inadequate to enable the displaced families to make both ends meet. Lack of resources adversely affected the education of their children, caused malnutrition and resulted into poor health, threatening the poor growth of young ones. The suffering people are at dharna for last 24 days and the Government is not bothered about this and no attention has been paid so far, it added.

The statement said in spite of repeated pleading, meetings with ministers and Legislators, the Temples and Shrines Bill has not been passed so far resulting into desecration and encroachment of these places. Further, 6000 posts assured in PM's package have not been filled so far and the development work at Jagti township has been put on hold. Under these circumstances attending the meeting of Apex Committee by KP's representatives will be meaningless, the statement added.

The statement said let the Government seriously address to the prime concerns of the community so that the Apex Committee meeting can be held in a meaningful way.

It said for today's meeting no agenda had been circulated and it only showed the casual approach of the Government towards holding such meetings.

It may be recalled that ASKPC chief A N Vaishnavi its general secretary, HL Chatta, Camp leader P L Raina and JKVM senior leader, Dr R L Bhat had also boycotted the meeting. Besides AIKS chief Moti Kaul could not attend the meeting due to his pre-occupation while Congress leader Ashok Bhan also chose to stay away from it. APMCCC president Vinod Pandit had already submitted his resignation from Apex Committee for its non performance.

Force used to disperse protest march by employees


Dozen injured, 150 arrested in police action

Over a dozen government employees were injured in police action during a protest march here while over 150 others were arrested. Normal work in government offices was almost paralysed in view of the strike call given by Employees Joint Action  (EJAC) in support of its demand against non implementation  of an agreement signed by  its leaders with the state government.

After today’s tough government action, EJAC has announced to intensify its “struggle” and called for a strike again on May and  a strike and “gherao” of civil secretariat here on May 9.

This morning large number of  employees led by their leaders reached near Khalsa School and  took out a protest march  towards the divisional commissioner’s office to submit a memorandum.  The state government had deployed in strength the police and paramilitary forces.

The cops swung into action at Exhibition Crossing and Jehangir Chowk and resorted to lathi charge and used water cannon to disperse the protestors.

At least one dozen government employees got injured in the police action and dozens of them were detained. They included Khurshid Alam and  Abdul Qayoom Wani.

However, the agitated employees showed stiff resistance and crossed the temporary barricades erected by police. The employees were again intercepted by large contingent of police.

A number of employees managed to escape from the spot  and later resurfaced at Jehangir Chowk and Exhibition Crossing where they held protests. Cops again used water cannon and lathi charge to disperse them.

Later police blocked all roads for the employees and prevented them to assemble. Normal life came to stand still at Exhibition Crossing and Jehangir Chowk during the march and police action.

The shopskeepers were forced to close their shops after the colour water entered into their shops which was used by police against protesting employees to disperse them. The shopkeeper expressed displeasure over the excessive use of water cannons.

The employees’ leader, Abdul Qayoom Wani told Kashmir Times that EJAC leadership has condemned the police action  The EJAC president termed protest programme genuine since  the agreement was violated by government.

The employees leaders alleged that government’s delay in releasing the arrears have put their families in great trouble financially in this time of inflation.

The employees have been demanding 6th pay commission arrears in cash, regularization of daily wage workers, contractual workers, removal of the pay anomalies of the clerical staff, in cash payment to the retired employees and early settlement of their other arrears andg enhancement of retirement age from 58 to 60 years.

Another employees union, EJAC Kashmir senior leaders Shabir Ahmad Langu, Ishtiyaq Beg, Sheikh Majid, Imtiyaz Khan and Nazir Ahmad Qadri told media persons that today’s strike call was a flop show. They gave a separate hunger strike call on May 7 for the implementation of six pay commission recommendations.

Governor CM pay tributes to Dr Ambedkar


Governor N. N. Vohra and Chief Minister Omar Abdullah today paid tributes to Dr. B. R. Ambedkar on his 121st birth anniversary.

In a message, the Governor recalled that Dr. Ambedkar, a most outstanding legal luminary, had made a signal contribution to the framing of the Indian Constitution. He also recalled Dr. Ambedkar's invaluable contributions towards nation building, particularly in regard to the uplift of the weaker sections of society.

Highlighting his role as a social reformer of highest order and a statesman of par-excellence, the Chief Minister said that the best way of paying tributes to Dr. Ambedkar is to strengthen the communal harmony in the country and contributing to create classless society with equitable development.

Move offices to close on April 27


To reopen in Srinagar on May 7

Annual Durbar Move offices will close here on April 27 and reopen in 1 Srinagar- the summer capital of the state, on May 7. According to a government order issued here today, the government offices observing 1 five days week shall close at Jammu on April 27, 2012 after the office hours whereas the  offices observing six days week shall close on April 28, 2012 after the office hours and  reopen at Srinagar on May 7, 2012 for annual Durbar move. It has been ordered that the offices moving in camp shall carry only 33 percent of the  strength of staff in that particular office or with 10 officials whichever is minimum. All  departments have been asked to send their advance parties on April 23 consisting of one  Gazetted Officer and four to five non-gazetted employees who will receive the records at  Srinagar.

 The departments shall ensure that boxes are properly locked and their keys reach the  advance parties at Srinagar well in time. The SP Security, Civil Secretariat will furnish a  list of defaulting departments in this regard to the General Administration Department. J&K SRTC will also make available trucks for shifting the records from Jammu to  Srinagar. Loading of records in the offices located outside the Secretariat premises,  observing six days week, shall take place after working hours on April 28, 2012. The  loaded trucks shall leave for Srinagar on April, 29, 2012 in a convoy.  The S.P Security, Civil Secretariat will ensure entrance of trucks/records in the Civil Secretariat, Jammu/Srinagar after proper scrutiny. The Police will escort the ‘employees’ and the ‘records convoy’ all along the route up to their respective destinations. The move convoy will be given precedence in crossing the Jawahar Tunnel. Director General of Police, J&K will issue necessary guidelines to the field agencies accordingly. It has been ordered that no moving employee would occupy any government/E.P/  Municipal residential accommodation except under proper allotment order. Moreover the move employees can retain the government accommodation allotted to them at Jammu for bona-fide use of their families under intimation to the Estates department on applicable terms and conditions.

 The moving employees having Ration Cards at Jammu would surrender the same to the Director, Consumer Affairs and Public Distribution Department, Jammu and  obtain a surrender certificate. The Director, Consumer Affairs and Public Distribution Department, Srinagar would issue ration cards to move employees at Kashmir on the opening of the Offices. The employees who desire to move without families may retain the Ration Cards at Jammu for the Summer Season. The office timing on the reopening of the offices at Srinagar shall be 9.30 AM to 5 PM in respect of Civil Secretariat and heads of department located within the Civil Secretariat  premises and 10 am to 4 pm in respect of all moving Departments located outside the Civil Secretariat and observing six days a week.

 Govt played fraud with institution of Legislature: Baig

Accusing the State Government of facilitating continuation of serious financial irregularities, former Deputy Chief Minister and senior People’s Democratic Party (PDP) leader, Muzaffar Hussain Baig, today said that Government has played fraud with the institution of legislature by tabling on last day of the Budget Session the report of the Comptroller and Auditor General (CAG), which has brought to fore massive frauds, misappropriation of funds, unauthorized, unfruitful and unproductive expenditure of several crores of rupees.

Talking to media-persons at party office here this evening, Mr Baig said, "there was political purpose behind tabling of the CAG report on last day of the Budget Session as CAG has completely exposed the National Conference-led Government for facilitating serious financial irregularities and allowing the defaulting officers to go scot free".

"As per the parliamentary practice, the audit reports are tabled on the Floor of the House for discussion on the same and take corrective steps based on the outcome of such discussion but by intentionally delaying the tabling of the report the National Conference-led Government has defeated the very objective behind audits of the functioning of the Government departments", he said.

Stating that Government has played fraud with the institution of legislature, he said, "by denying the opportunity of discussion on the findings of the CAG the Government has tried to render the Legislative Assembly and Council ineffective and disabled", he said, adding "the discussion on the CAG report was imperative as it has made startling revelations about fraud, embezzlement, misappropriation of funds, excess payment/ wasteful expenditure and diversion of funds".

Terming the CAG findings as just tip of an iceberg, the former Deputy Chief Minister said, "if such glaring financial irregularities can be detected in the sample survey of some works in 8-10 departments what could be the state of affairs in all the departments, can easily be presumed", adding "had the report been tabled just at the beginning of the Budget Session we would have completely exposed the Government during the discussion on Budget as well as grants of different departments but unfortunately the Government had denied this opportunity to the Opposition, which otherwise would have been of immense benefit in checking the financial irregularities in future".

Picking up some startling figures from the CAG report, Mr Baig said that in 2010-2011 an amount to the tune of Rs 9010.80 crore was available with the Government as Capital Expenditure but it could not spend Rs 2289.77 crore despite the fact that percentage of capital expenditure indicates economic growth. Similarly, an expenditure of Rs 31288.58 crore was registered against total original and supplementary grants of Rs 28920.27 crore thereby registering excess expenditure of Rs 2368.11 crore. 

Stating that Government was spending more on non-productive sector than the productive sector that too without seeking permission from the Assembly, he said that in 2009-10 the Plan expenditure was to the tune of Rs 6688 crore but in 2010-11 the same declined by Rs 49 crore to Rs 6639 crore. On the other side, Non-Plan expenditure increased to Rs 17892 crore in 2010-11 as against an amount of Rs 14870 in 2009-10.

"This shows decline in development activities with a sharp rise in non-development expenditure", he said, adding "the reasons for this shortage in the development expenditure have not been explained by the State Government to the CAG".

"The excuse of the Government that revenue expenditure registered steep rise because of 6th Pay Commission appears to be false because the projected wages and salaries for 2010-11 were Rs 13173 crore whereas actually it was only Rs 7772 crore", he said, adding "the Government is answerable to the people as to why it has not utilized Rs 6000 crore to pay the arrears to the employees or to clear the loans it had taken". 

"Such an amount could have even been utilized to provide employment to two lakh people at least for 3-4 years", he added.

Pointing towards under-spending to the tune of Rs 3762.45 crore in 12 grants in 2010-11, he said, "the functioning of the Finance Department can be gauged from the fact that it has failed to spend Rs 367.60 crore under Revenue Component and Rs 387.82 crore under Capital Component", adding "similar is the fate of another vital department—Planning and Development, which has failed to spend Rs 679.61 crore under Capital Component".

About the CAG’s startling revelations viz-a-viz the rush of expenditure during the month of March", he said, "it is not understandable as to how an expenditure ranging between 51 per cent to 77 per cent can be registered in one month only", adding "the CAG findings have also proved wrong the tall claims of the Finance Minister, Abdul Rahim Rather about tax realization".

Mr Baig also expressed concern over how the Government got constitutional amendment bill pertaining to reservation to SCs/STs/OBCs introduced and passed on the last day of the Budget Session. "We were not against the reservation to these sections of society. Had there been discussion we would have stressed for extension of same for 20 years", he said.

About the report of House Committee on sanctioning and upgradation of health centers, he said, "the report has brought to fore how the Ministries used influence for providing benefits to selective constituencies at the cost of deserving ones".

Govt nod to DDCs to go ahead


In a major decision aimed at ensuring continuation of development works across the State due to delay in sanction of annual plan, the Government has directed the District Development Commissioners (DDCs) to go ahead with the works without waiting for plan sanction. The Government proposed to use its own internal resources for funding the development works.

Official sources told the Excelsior that since the months of summer accounted for major working season in many hilly areas of the State and plan amount was unlikely to be released before next couple of months, the Government, like the previous couple of years, has given a nod to the DDCs to go ahead with ongoing development works, which would be funded by the State’s internal resources, which have witnessed a significant increase during just ended financial year of 2011-12.

"We have directed the DDCs to go ahead with all ongoing development works without waiting for sanction of annual plan of the State for 2012-13. The DDCs would get the funds from internal resources of the State till annual plan of the State was finalized by the Planning Commission of India’’, they said.

They added that the DDCs have, however, been directed not to undertake new development works till finalisation of the plan followed by District Development Board (DDB) meetings.

"We have enough amount from our internal resources to ensure that ongoing development works didn’t suffer in any part of the State especially the hilly and far flung areas, which have limited working season in the months of summer as they remained snowbound for most of the winter months’’, sources said.

They pointed out that the DDCs have been told that sufficient funds would be available for the schemes after the sanction of State’s annual plan either in May or June and payments to the contractors, where heavy amount was required, could be released later.

Earlier, the development works used to suffer due to delay in sanction of annual plan but the Government has now ensured that the ongoing works continued uninterrupted without waiting for plan sanction as they will be funded from own resources of the State.

According to sources, annual plan of the State for current financial year of 2012-13, which was pegged at Rs 7300 crore in annual budget, was likely to be sanctioned in May or June after a couple of rounds of the meetings between State bureaucrats and top brass of the Planning Commission of India.

First round of the meeting of State bureaucrats with the Planning Commission officials was held on December 15 last year. The meeting among others was attended by Principal Secretary to Chief Minister, BB Vyas, Incharge Planning and Sudanshu Pandey, the then Principal Secretary, Finance. Mr Pandey has since been replaced by Mohammad Iqbal Khandey as Principal Secretary Finance and he would represent the Finance Department in next meeting with the Planning Commission of India.

Finance Minister Abdul Rahim Rather had pegged State’s annual plan at Rs 7300 crore and Prime Minister’s Re-construction Plan (PMRP) at Rs 700 crore while presenting annual budget in the Legislature on March 6. Sources said the Government was confident of getting same amount of plan and PMRP as the Planning Commission had assured the State of 10 per cent step up in the plan for the current financial year of 2012-13 as compared to last fiscal year of 2011-12 when the State was given Rs 6600 crore worth plan.

Sources said the Planning Commission in its first meeting with the State bureaucrats had sought the details of targets of Own Tax Revenue in the State, reforms in different sectors and expenditure of current financial year’s plan. The Planning Commission had expressed satisfaction over all three issues.

The State bureaucrats had apprised the Planning Commissioner and the Union Finance Ministry officers that it had already initiated some austerity measures but due to security considerations it was not in a position to take more such steps.

The delegation apprised the Planning Commission that the State’s power revenue was also increasing but a big gap remained between power bill and revenue as it can’t initiate all reforms in one go.

"It was in view of this that the State Government had batted for annual power reforms grant to the tune of Rs 2000 crore for few years till the State managed to bring reforms and improve its revenue’’, sources said, adding that the Planning Department assured to give a thought to the State’s demand.

Worthwhile to mention here that J&K Government was given Rs 1300 crore worth annual power reforms grant for three years in 2006-07, 2007-08 and 2008-09. The grant was later stopped as the Government didn’t take significant power reforms then.

At least two meetings were likely to be held at the official level between the State Government and the Planning Commission before the annual plan was finalized. 

The annual plan for 2012-13 and other grants to the State for the next financial year would be finally clinched next year in a meeting between Chief Minister Omar Abdullah, Finance Minister Abdul Rahim Rather and Planning Commission of India Deputy Chairman Montek Singh Ahluwalia.

During current financial year, the State had been allocated Rs 6600 crore worth annual plan and Rs 1200 crore under PMRP. The State has asked for a 10 per cent step-up in the annual plan for next financial year, which comes around at Rs 7300 crore.

The Planning Commission has also asked the State Government to give projections for 12th five-year plan, which begins April 1, 2012. The 11th five-year plan ended on March 31 this year.

The State was working out the amount, priority sectors and other requirements to be projected before the Central Government and the Planning Commission for 12th five-year plan in the next few days.

The Ministries of Finance and Planning were engaged in hectic consultations over the amount and priority sectors for 12th five-year plan, whose first meeting was expected to be convened by Union Finance Minister Pranab Mukherjee shortly.

CCS to decide on AFSPA


The final call on the contentious issue of revocation of Armed Forces Special Power Act (AFSPA) from J&K will be taken by the Cabinet Committee on Security (CCS).
 This message was loud and clear when the Union Minister for Home Affairs P Chidambaram Tuesday wrapped up his day long visit to the winter capital of the state.
 “The Ministry of Home Affairs has proposed three amendments to Armed Forces Special Power Act (AFSPA). They are under the consideration of the Cabinet Committee on Security (CCS). Once a decision is taken, we’ll announce it,” was the precise reply of Chidambaram during his brief media interaction, while winding up sojourn to Jammu.
 No elaboration, however, was made on the nature of the amendments proposed.
 Ditto was the status of interlocutors’ report, which he said, would be made public after the CCS considered the matter.
 “Interlocutors’ report, as I said in Delhi, will be made public after the Cabinet Committee on Security (CCS) considers the matter,” Chidambaram said.   
 After meeting different delegations including Congress leaders’ delegation at J&K Guest House, the Union Home Minister was responding to media queries vis-à-vis the reiteration of the Chief Minister Omar Abdullah about AFSPA revocation from selective areas in J&K and the fate of interlocutors’ report.
 The two issues, which presumably also figured during the security review meeting chaired by the Chief Minister and the Union Home Minister and the luncheon meeting at Raj Bhawan today, have been repeatedly raked up by the former on different occasions.
 On AFSPA revocation issue, in his brief sound byte today, the Union Home Minister almost appeared to be on the same page with the JKPCC President Prof Saif-ud-Din Soz.
 JKPCC president on Monday almost on similar lines had stated that the Government of India would decide the point of time about the revocation of AFSPA.
 “As and when the Government of India takes a decision, it will decide the point of time,” Soz had said when asked to comment as whether this was the ripe time for AFSPA revocation as was being insisted by the Chief Minister Omar Abdullah.
 However, Omar in the just concluded budget session of J&K legislature had stated the process of partial AFSPA revocation from selective areas would start this year.
 In the meanwhile, notwithstanding the hectic lobbying by the Chief Minister for AFSPA revocation from selective areas in J&K, the state Congress leaders adopted a contradictory position during their meeting with Chidambaram.
 As the Member Parliament (MP) Madan Lal Sharma, while talking to media outside the guest House, stated that though the issues of AFSPA revocation and interlocutors’ report were not discussed during Congress leaders’ meeting with the Union Home Minister yet the party leaders themselves aired their views on the contentious issue (AFSPA revocation). “We made our stand clear on this issue in a subtle manner that the time was not ripe for its revocation,” he said.
 Faced with a query as their alliance partner (NC) held entirely a contradictory stand on this account, his one-liner was, “That’s their view point.” 
 JKPCC president Prof Saif-ud-Din Soz, however, steered himself clear of any controversy by charting a safe recourse while responding to media queries about the deliberations between the Congress leaders and Chidambaram.
 “During our deliberations with the Union Home Minister, there was a positive message for us. There’s great improvement in the environment which will give a tremendous boost to the tourism here, thus bringing prosperity to J&K. Therefore the Congress party would have to contribute more in maintaining and giving further impetus to this improved security situation scenario to consolidate the dividends of last peaceful summer,” Soz stated.
 He added that the Union Home Minister was satisfied with the Congress’ all out efforts in further improving the situation. “As a senior leader of the party, he listened to us and offered his suggestions,” Soz said.
 The Congress delegation also raised the issue of West-Pak and PoK refugees and sought Rs 300 Cr central package for their one-time settlement. The issue of migrants from Doda, Reasi and other regions of Jammu too echoed during the meeting with the local leadership stressing that they should be treated at par with the Kashmiri migrants.
 The Union Home Minister asked the party leaders to remain alert against the attempts by certain forces to exploit the situation to vitiate the atmosphere as it happened in case of Amarnath row and Shopian case in the past few years. The Congress leaders from Ladakh expressed their concerns about increased activities of China in the cold desert.
 “It was a subtle interaction from both sides on varied range of issues. Although the party leaders conveyed their concerns yet all refrained from aiming barbs at the coalition partner. General mood was that the army, security forces’ presence was still imperative in the state but it was conveyed in a very subtle manner. The Union Home Minister, however, did not respond on this issue. One of the leaders raked up the issue of Congress’ thinning share in portfolios yet he (Chidambaram) in his inimitable manner evaded the matter saying JKPCC President would represent the party on this issue,” stated another senior Congress leader, who too was present in the meeting.
 Earlier on his arrival from New Delhi in the morning, the Union Home Minister visited Shri Mata Vaishno Devi shrine and paid obeisance at the Sanctum Sanctorum. He prayed for peace and prosperity of the state and the country. CEO Shri Mata Vaishno Devi Shrine Board, Naveen Chowdhary apprised the Home Minister about the facilities being extended to the pilgrims and the overall security scenario enroute the shrine. He also briefed the Home Minister about the infrastructural projects taken up by the Shrine Board in view of the ever increasing pilgrimage.
 After his arrival from Vaishnodevi, Chidambaram along with the Chief Minister Omar Abdullah reviewed the prevailing law and order and security situation in the state at a high level meeting at the latter’s residence.
 From the Chief Minister’s residence, the cavalcades of Chidambaram and Omar drove to Governor House at 1.20 PM. There during an hour long luncheon meeting, Chidambaram had wide ranging consultations with Governor N N Vohra and the Chief Minister on the pace of socio-economic development of the state, internal and external security management, measures taken for empowerment of Panchayati Raj institutions and ensuing elections to the urban local bodies.
 From Governor’s House, Chidambaram reached J&K Guest House where the deputations of Congress leaders, All Party Sikh Coordination Committee (APSCC) and Pahari Cultural and Welfare Forum (PCWF) called on him.
 APSCC delegation demanded general amnesty to Sikhs of Kashmir involved in the 1984 Indian Airlines plane hijack case, as was done in case of separatist leader Hashim Qureshi, fresh probe in Chittisinghpora massacre under a timeframe and a central authority for providing state subject status at par with Kashmiri migrants.
 The delegation also raised demands for an employment package and extension of Minority Act to J&K.
 PCWF delegation reiterated demand for ST status for Pahari speaking people.

Govt resists cross-examination of CM, MoS Home, 
other witnesses

The State Government has resisted the cross-examination of all the witnesses including the Chief Minister, Omar Abdullah, Minister of State for Home, Nasir Aslam Wani, Political Advisor to Chief Minister, Devinder Singh Rana and other ‘key’ witnesses in the much publicized death of National Conference worker Syed Mohammad Yusuf Shah alias Haji Yousaf.

Authoritative sources told Jk News that some days back Mushtaq Ahmad Dar, the counsel for the deceased’s family, moved an application before Justice H S Bedi Commission seeking permission to cross-examine all the witnesses in the Haji Yousaf murder case.

Accordingly, the Comm-ission invited objections from the State Government in response to the application of Mushtaq Ahmad Dar and the same were submitted yesterday in which the Government has resisted the cross-examination of all the witnesses on various grounds, sources said.

The Chief Minister, Omar Abdullah, Minister of State for Home, Nasir Aslam Wani, Political Advisor to the Chief Minister, Devinder Singh Rana, Inspector General of Police (Crime Branch), Dr Noor, who had conducted the post-mortem of Haji Yousaf, are among 12 persons, who have been arrayed as witnesses in the much publicized case, sources disclosed.

They said that Commission has adjourned the proceedings in the case till April 27 as the counsel for the Chief Minister has pleaded his inability to appear before April 21 due to some prior engagements. 

"On April 27, there will be arguments on the application of Mushtaq Ahmad Dar seeking cross-examination of the witnesses and affidavit of the Government resisting the same", sources said, adding "it would be only after hearing the arguments from both the sides that the Commission will take any decision on this vital aspect of the case and initiate further proceedings".

In response to a question, sources said, "as per law, opportunity of cross-examination of the witnesses cannot be denied to the counsel of the aggrieved party. However, before allowing the same the Commission will have to decide as to who are the relevant witnesses, whose cross-examination would be of considerable help in the case".

"The application seeking cross-examination of all the witnesses in the case was moved by the counsel of Haji Yousaf’s family after visiting the residence of Chief Minister where Yousaf was summoned on September 28, 2011, a day prior to his death allegedly under mysterious circumstances", sources further said.

Replying to another question, they said, "it would be only after the decision on the cross-examination of the witnesses that the Commission would be in a position to decide whether it can complete its task within the latest deadline fixed by the Government on its request", adding "at present the Commission has time till May 28 to complete the probe and submit report".

It is pertinent to mention here that Haji Yousaf was handed over to IG Crime Branch by the Chief Minister, Omar Abdullah on September 29 last year after he (Haji Yousaf) allegedly admitted to taking money from two NC workers for getting them favours from the Government.

He died a day later and the medical tests so far have revealed that he died of cardiac arrest and that there were no external injuries on his body. His death after he was summoned by Chief Minister Omar Abdullah on September 28, 2011 to ascertain whether he was taking money from people on the pretext of getting them Ministerial berths, snowballed into a political controversy with top leadership of NC being directly accused by the Opposition parties in the State.

After Haji Yusuf’s death, the Chief Minister ordered a judicial probe by a sitting J&K High Court Judge. However, after Chief Justice of State High Court expressed his inability to spare a sitting judge, the Government wrote to the Union Law Ministry to provide panel of three retired Supreme Court Judges.

Accordingly, the Union Law Ministry proposed the name of Justice H S Bedi, a retired Judge of the Supreme Court, and subsequently a Commission of Enquiry was appointed by the State Government in exercise of the powers conferred under Section 3 of Jammu and Kashmir Commission of Enquiry Act, 1962 to enquire into the causes and circumstances leading to the death of Syed Mohammad Yusuf Shah, son of Sayed Ghulam Ahmed of Loktipora, Bijbehara in Anantnag district

PC arrives today


Union Home Minister P Chidambaram, on his one day visit to the winter capital of the state, is arriving here on Tuesday morning. He is scheduled to visit Mata Vaishno Devi cave Shrine, besides security review meeting  with the Chief Minister Omar Abdullah and meeting with few delegations. The meeting
 with state Congress leaders is also on his itinerary.

 The Union Home Minister will arrive at Jammu airport at 8.15 AM in his special plane. The Governor N N Vohra, who is also the chairman of Shri Mata Vaishno Devi Shrine  Board and is presently on tour to New Delhi, will accompany the Union Home Minister. From Jammu airport, Chidambaram will fly to Mata Vaishno Devi Cave Shrine situated  in Trikuta Hills in district Reasi to pay obeisance to the Goddess. From there, he will fly  back to Jammu. At around 11.20 AM, he will have a meeting with Chief Minister Omar  Abdullah at CM’s official residence in Jammu.

 At 1.00 PM, he will have a security review meeting at the Chief Minister’s residence. Around 1.20 PM, the Union Home Minister will leave for Governor House.
 During their meetings with the J&K Governor and the Chief Minister, he will deliberate  on the security scenario in the state. The deliberations are likely to revolve around  revocation of Armed Forces Special Powers Act (AFSPA) and dismantling of more  bunkers and reducing footprint of security forces in the state.

 At around 2.00 PM, Chidambaram will meet few delegations at the state Guest House including the delegation of Jammu and Kashmir State Pradesh Congress Committee  (JKPCC) headed by Prof Saif-ud-din Soz and a delegation of Sikh Coordination Committee headed by Jagmohan Singh Raina. At around 4.00- 4.30 PM, he will fly back  to New Delhi. Meanwhile, the security has been stepped up in Katra- the hilly town of Reasi district ahead of Union Home Minister's scheduled visit to the Shri Mata Vaishno Devi Cave Shrine tomorrow. Tight security arrangements have been put in place in Katra town, the base camp of Cave Shrine, en route the Bhawan. Additional police and para-military personnel have been deployed along the 13-kilometre long track. Besides, tight security, checking of hotels and lodges has also been intensified. Hoteliers have been asked to remain alert and maintain vigil.

One time settlement proposal for KP Migrants returned


The state cabinet today gave a go ahead to the proposal of Information Technology (IT) department vis-à-vis implementation of National Population Register (NPR) project in Jammu and Kashmir in place of Aadhar project.However the cabinet returned `one-time settlement’ proposal of Revenue department with regard to return and rehabilitation of Kashmiri Pandit migrants to the department for making it a “certain, comprehensive package with all requisite details intact.”

Sources stated the Chief Minister Omar Abdullah, who chaired the cabinet meeting, directed the department to identify shortfalls in the package. He asked it to come out with this package proposal complete in all respects with all the requisite details about the families interested for return and the details of financial implication of the package with the exact amount to be spent.

Besides the proposal pertaining to package for Jammu migrants to bring them at par with the Kashmiri migrants, too should be comprehensively framed and brought before the cabinet along with it, the Chief Minister directed. In the recently concluded budget session Minister for Revenue, Relief and Rehabilitation
Raman Bhalla had stated that the state government was working on a comprehensive return and rehabilitation policy for Kashmiri Pandit migrants in Kashmir Valley and 4,440 Pandit families had applied under this policy so far.

He had said the government had submitted a comprehensive one-time settlement package to the Centre for funding. The cabinet also deferred the proposal of the Revenue department regarding the enhancement of honorarium of Numberdars and Chowkidars from existing rate of Rs 501 per month to Rs 1501 per month and from Rs 500 to Rs 1500 per month respectively.Sources said that the proposal was deferred as the government was contemplating to bring proposal for honorarium for Panchs and Sarpanchs also along with it after deciding the amount. The proposals may be taken up in the next cabinet meeting. 

After the cabinet gave a go ahead to the proposal of Information Technology (IT) department vis-à-vis implementation of National Population Register (NPR) project in Jammu and Kashmir in place of Aadhar project like most North Eastern States, the Memorandum of Understanding between the state government and the J&K Bank, which was signed on July 18, 2011, would be withdrawn. The Aadhar project of UID Authority of India was replaced with National Population Register as per the Government of India decision to implement National Population Register by Registrar General and Census Commissioner, Ministry of Home Affairs in the state after synchronizing the procedures for the two projects.

The cabinet also approved revised incentives for tourism as an `industry’ by modifying the existing rules governing the package of incentives.The modifications will supersede government orders and the regulations notified in 1995.Under the revised incentives, the list of areas and locations, where the tourism units will
be eligible to get incentives as per new package, will be liberalized and expanded with a new limit for the capital outright investment subsidy and increased limit on amount of capital subsidy in case of prestigious units.

Besides, the selection of Patwar Trainees through J&K Board of Professional Entrance Examination (BOPE) was also okayed with the modifications that the examinations would be conducted by the BOPE at the district level by associating the concerned Deputy Commissioner and making selection in accordance with the reservation rules. The cabinet also approved transfer of state land measuring 192 Kanals and 34 Marlas under Khasra No 169/172/411/1013/412, situated in estates Namble Narkara and Hamchipora of tehsils Budgam and Khag respectively of district Budgam, in favour of Sher-e-Kashmir University of Agriculture Science and Technology, Shalimar Srinagar for establishment of Krishi Vigyan Kendra.The transfer of land measuring 300 Kanals and 5 Marlas situated in villages Hrudubani, Lalpora and Mangloora of tehsil Tangmarg, district Baramulla, for establishment of Krishi Vigyan Kendra Similarly, the cabinet also approved transfer of state land measuring 362 Kanal and 13 Marlas for construction of Krishi Vigyan Kendra at village Marta and construction of residential quarters for employees of Krishi Vigyan Kendra in village Ramnagr, Tehsil Ramnagar, district Udhampur.

Govt committed to dignified return of migrants


A Samohik Yagnopavit (wearing of sacred thread) of 18 boys was solemnized by Swami Kumar Ji Geeta Satsang Ashram in the Ashram premises at Muthi camp.

The three -day long function started on April 7 evening and it concluded with Puranahuti this evening. Minister of Revenue Relief and Rehabilitation Raman Bahlla was the chief guest on the occasion. The function among others was attended by Mubarak Gul, Political Advisor to Chief Minister, Sartaj Madni, Deputy Speaker Legislative Assembly, Vijay Bakaya MLC, H L Pandita, general secretary PCC, Migrant Cell, Dr K L Chowdhary, K K Khosa senior vice president KP Sabha, Dr Sushil Wattal, Dr Ramesh Bhat, Kuldeep Riana and members of Prem Nath Bhat Memorial Trust.

Addressing the gathering Mr Bhalla said that Government is ceased of the problems of the displaced people and many steps have been taken in mitigating their sufferings.

He urged the migrants to cooperate with Government in implementation of PM's rehabilitation package. Maintaining that Government is committed to rehabilitation of the community in Kashmir Valley with honour and dignity he said the Rs 7.50 lakh package for construction of a house per family has been revised and fresh proposal of Rs 20 lakh has been submitted to center in this regard.

He said the appointment on 800 dereserved posts and 700 non joining posts is in pipeline while the 3000 posts under state sector will also be advertised soon.

Swami Kumar Ji also gave religious discourses and highlighted the importance of holding the Samohik religious functions. On the occasion copies of Shrimad Bhagwat Geeta were distributed by Kuldeep Raina among the gathering.

The devotees were served with prashad after Puranahuti.

CS interacts with KAS officers


With a view to improve administrative efficiency and to assess the problems being faced by the field officers, Chief Secretary, Madhav Lal held an interactive session with the J&KAS officers here today.

Secretary, GAD, Mushtaq Ahmed, Special Secretary GAD, G S Chib and other officers from GAD were present.

Nearly 30 KAS officers drawn from various departments from district Jammu, Udhampur, Kathua, Ramban, Kishtwar, Doda, Rajouri, Reasi, Poonch participated.

Speaking on the occasion, Madhav Lal emphasized the need for concentrating on the developmental issues and bring out innovative ideas to improve the delivery system with optimum utilization of available human as well as material resources. He emphasized for maximising the administrative efficiency for realising the desired goals.

He further suggested the officers to feel free to deliberate upon important issues with superiors to change the perception of the administration among the common masses.

The Chief Secretary encouraged the officers for their achievements in their respective fields. He also exhorted them to keep themselves well abreast of latest administrative innovations outside the state and the country through information technology.

"Mr Thatai of 1985 batch of IRS who has served in various capacities at New Delhi, Mumbai, Hissar and Amritsar, this morning took over as new CIT," official sources here said.

They said the new Commissioner Income Tax (CIT) has served in the State as CIT Appeals between 2005-2007.

Govt committed to revoke AFSPA


Terming PDP non co-operative over revocation of Armed Forces Special Powers Act (AFSPA), National Conference (NC) senior leader and Rural Development Minister Ali Mohammad Sagar today said that Omar Abdullah led Coalition Government is committed to revoke AFSPA.

Addressing party workers at Nawaz Subha, the National Conference senior leader said that more security bunkers would be removed from Srinagar city for easy movement of common people.

He said that National Conference led coalition Government will take all the stake holders including security agencies into confidence over revocation of AFSPA.

"Chief Minister is personally keen to revoke AFSPA as early as possible, as the security situation has drastically improved. We are in touch with the Central Government and we are hopeful both the Centre Government and State Government will take a final call over revocation of AFSPA ," he said.

Mr Sagar said that PDP is playing a negative role over revocation of AFSPA. "In Delhi, they oppose the sincere move of Omar Abdullah to revoke AFSPA. In Kashmir they are giving an impression to people that they are advocating revocation of AFSPA. We several times advised all the parties particular PDP not to do politics over AFSPA, but they are trying to politicize the issue," he said.

He said that Mehbooba Mufti and Muzzafar Hussain Beig are involved in worse kind blame game. He said they raised those issues in the assembly, which has no logic and sense. " They were intending to weaken the coalition, but the sincere and transparent system of Omar Abdullah foiled all their attempts," he said.

"The many more bunkers would be removed from the Srinagar as the security situation has drastically changed. More than 13 lakh tourists visited the State last year and in the few months only more than two lakh have arrived and the number is expected to increase in coming days,'. he said
He also said that Omar Abdullah has favoured that all the traditional routes should be reopened with Pakistan so that easy access would be available to the traders and common people of both the countries.

The Rural Development Minister also said that Omar Abdullah has also directed the security agencies that passport should be given to all those who have no link with the militancy. He also said that common people must not suffer while they apply for the passport.

He further said that State Government is committed to the safe return of the youth who had crossed over to Pakistan. He said that process is going on and state government is intending for their return so that they can live normal life with their families.

National conference provincial president Ali Mohammad Dar said that negative propaganda of PDP against the NC has been defeated by people as the Omar Abdullah led Government is becoming more popular on the ground.

Govt examining creation of 585 posts in Home Ministry

The Jammu and Kashmir Government today said that a proposal for creation of 585 posts in the state Home department is under consideration.

"At present, there is one proposal of the Home Department to create 585 posts of different categories which is under examination in the state Finance Department in Jammu and Kashmir," Finance Minister Abdul Rahim Rather told the state Assembly in reply to a question by member Abdul Majid Wani here.

The Finance Minister said that the decision on the proposal will be taken on merit.

Jammu and Kashmir government has created 24,693 posts during past three years which includes 6,301 gazetted posts, 15,378 non-gazetted and 3,014 class-IV posts in 38 Government departments, the minister said.

Centre convenes CMs meet on NCTC on May 5

Conceding the demand of three Chief Ministers including ally Mamata Banerjee, the Centre has convened a stand-alone meeting on May 5 to discuss NCTC which has been held up due to stiff opposition from several states. Addressing a press conference here today, Home Minister P Chidambaram hoped that a "very good outcome" will be achieved after the deliberations as everyone realises the fact that India is one of the most vulnerable countries from terror attacks in the world. "Following the requests of three Chief Ministers, the Prime Minister has asked me to convey to the Chief Ministers that a separate meeting on NCTC can be held on May 5. I have written to all Chief Minister and I hope that they will all confirm their participation," he said. He said the April 16 meeting of the Chief Ministers will discuss issues referred on the agenda which was already circulated while the May 5 meeting will primarily discuss the NCTC. West Bengal Chief Minister Mamata Banerjee, Tamil Nadu Chief Minister J Jayalalitha and Odisha Chief Minister Naveen Patnaik apart from several others have objected to setting up of the proposed anti-terror hub saying it would infringe upon the states' powers. They had been demanding that a separate meeting of Chief Ministers should be convened to exclusively discuss the NCTC as the April 16 meeting called to discuss internal security situation would not have enough time to deliberate on NCTC. Chidambaram said he was confident that given the kind of situation in which many countries in the world, including India, faces, the Chief Ministers would respond positively. He said over 100 terror incidents had taken place in 2011 worldwide and bulk of them took place in Afghanistan, Iraq, India, Pakistan and Thailand. "This is the area which is most vulnerable to terrorist attacks. LeT functions in this area, Hizbul Mujahideen functions in this area, al Quaeda shadow falls in this area and al Quaeda operates in Afghanistan, Iraq and Middle East. So, I think it is important that we recognise that we must institutionalise the fight against terrorism. "There must be an institutional mechanism, institutional personnel, that is the genesis of the NCTC. The idea was accepted by the Jaswant Singh Committee, by the Second Administrative Committee. I think once we sit down, discuss these matters, I am confident that there will be a very good outcome," he said. The Home Minister denied that there was any difference between the Central and some state governments on NCTC. He said if one reads the executive order (for establishment of NCTC) carefully, one will find that it simply reflects the legal position as was found in the Unlawful Activities (Prevention) Act and its last paragraph facilitates setting up of a Standing Council. Chidambaram said in the Standing Council, the Central government will have four members-the Director and three Joint Directors while the states will have 28 members, each state will have one member. "So in a 32 member standing council, states will have 28 members. It is the Standing Council which will oversee the NCTC. I think there are some differences on emphasis or how to naunce a particular idea or how to rephase a particular paragraph. I think these can be worked out.

Mufti questions intention of Govt to hold ULBs polls

 Lambasting Omar Abdullah led coalition regime for eroding sanctity of democratic institutions in State, patron of Peoples Democratic Party (PDP) Mufti Mohammad Sayeed Mufti today questioned intention of the State Government to hold Urban Local Bodies (ULB) elections. He regretted that instead of taking some steps to strengthen democracy at grass root level, the State Government was looking for excuses to delay the ULB elections.

Addressing a meeting of party workers of Bishnah Assembly segment at Pandorian, PDP patron said elections of Urban Local Bodies including Jammu and Srinagar Municipal Corporations were scheduled to be held in the month of February 2010 but Government has been postponing these elections with one or other excuse.

"I failed to understand why Government is shying away from its duty to conduct these elections. Formation of Urban Local Bodies are must to empower the people of urban areas", he remarked and added that in a democratic system it was necessary to make representative character of all democratic institutions to ensure people's participation in these institutions.

Taking a dig at coalition regime for not fulfilling its promises to conducting local bodies elections, Mufti Sayeed pointed out that during the last two years Government has repeatedly announced to conduct these elections but these announcements remained only on papers.

"Even in the Governor Address during the current budget session of the Assembly, the Government has promised to conduct local bodies elections", he recalled but added that no notification has been issued so far which substantiate PDP's apprehensions that this regime was not interested in conducting local bodies elections.

PDP patron also flayed coalition regime for not empowering the Panchayats. "Those demanding greater autonomy for the State are hesitating even to delegate powers to the duly elected Panchayats", he said and pointed out that almost one year has passed after completion of Panchayat elections but neither block Smities nar Zila Committees have been constituted.

PDP patron warned that his party would strongly oppose gimmick of the ruling NC to undermine institutions and to control these institutions through deceit tactics. "We will agitate for strengthening democratic institutions in the state", he asserted.

Speaking on the occasion, former Deputy Chief Minister Muzaffar Hussain Beig said that eroding democratic institutions and controlling such institutions through illegal means was history of the NC. "Since 1947, successive NC regime has been propagating divisive politics to remain in power", he said and added that wrong policies adopted by the NC were responsible for all ills in the State.

He regretted that for petty political gains, NC leadership has always tried to create division between people of different regions. "It was only after 2002 when Mufti Mohammad Sayeed became Chief Minister of the State some sincere efforts were made to bridge the gap", he said.

Nurboo Gailchan raised the issue of stranded students of Leh particularly Zanskar due to closure of road and demanded their airlifting.

Rafiq Ahmad Shah raised the issue of two roads of Trehgam and Kralpora blocks and demanded their early completion.

Mohammad Ashraf Mir raised the issue of affected families due to Dal Development Project and demanded their early rehabilitation.

Murtaza Ahmad Khan raised the issue of up-gradation of high schools of Poonch, Mendhar and Surankote and demanded fulfillment of commitment made by the Government.

Dr. Bashir Ahmad Veeri demanded adequate irrigation facilities for Horticulture fields besides timely provision of pesticides and sensitizing orchardists about the benefits of technology mission.

Vijay Bakaya raised the issue of filling up of 800 posts meant for Kashmiri Pandits and demanded early implementation of Cabinet decision taken in this regard.

Javed Rana raised the issue of farmers of Poonch district living near borders who have to pass daily through several army check posts and sought intervention of Divisional Commissioner and Deputy Commissioner to take up this issue with Army authorities in order to ease the checking process.

Dharam Bir Singh Oberai raised the issue of cooking gas shortage in South Kashmir and demanded supply from Pampore.
