Division Bench of State High Court comprising Justice Virender Singh and Justice Muzaffar Hussain Attar today directed the State Government to complete the exercise of framing rules of Dowry Restrained Act, 1960, within a period of four months.
The directions were issued in a Public Interest Litigation (PIL) filed by Advocate Meharban Singh seeking direction to the State to implement Dowry Restrained Act 1960 in its letter and spirit and formulate relevant rules for proper enforcement of the Act.
Earlier, in response to the previous directions of the court, the State Government filed a detailed reply through Additional Secretary to Home Department Mohd Iqbal Mir with a chart supplied by Staff Officer to IG Crime Head Quarters reflecting the figure of registration of cases under Dowry Restrained Act 1960 of last five years from 2007 to ending January, 2012.
In view of the reply submitted by the State, Senior Advocate S S Lehar appearing for the PIL submitted that the main purpose of filing the present PIL was to get to the rules framed by the State so as to enforce the provisions of the Dowry Restrained Act effectively.
After hearing Senior Advocate S S Lehar assisted by Advocate Amit Gupta for the PIL whereas AAG Gagan Basotra for the State, the Division Bench observed, "in view of the concern shown by the State in implementing the Dowry Restrained Act, 1960 effectively by framing the relevant rules, may at a belated stage, that too after the Court took serious note of it, the instant Public Interest Litigation is disposed of with a direction to the State to complete this exercise within four months positively".
